In a landmark judgment, the Supreme Court of India has ruled that online gaming companies must pay 28% GST on the full value of bets placed on their platforms, and not just on the platform fee or commission they earn.
The Court also agreed with the government’s view that the 2023 GST amendments were clarificatory in nature, thereby supporting retrospective tax demands.
